Our terms and conditions
In the under mentioned terms ‘We and ‘Us’ shall mean Kennick Photography and ‘You’ and ‘your’ will mean you, the client.

In signing our order form you agree to the terms stated below. The following terms set out the agreement made between you and us.

It is agreed that no modification or variation to this contract will be effective unless such modification or variation has been agreed by both parties in writing. In the event of dispute between you and us over any matter whatsoever, it is agreed that the terms stated below will prevail.

Exclusivity
You agree that we will be the sole photographer at the event, for which you have engaged us, as stated on our order form. In turn we agree that we will not book any other work on the day on which your event takes place.

Payment for services
The package and associated cost will be agreed with you before the event.

To secure a wedding booking, we will require a deposit amounting to X% of the wedding package price.

The deposit is non-refundable

Any pre-agreed residual balance must be paid, in cash, on the day of the event, prior to any photographs being taken. We will not undertake work until payment is received and will assume that our services are no longer required.

Any expenses for travel or accommodation will be agreed with you before the event and are subject to the same terms as stated above.

If you require images in addition to those incorporated within the agreed ‘package’ then payment is to be made, in cash, at the time the prints are ordered.

We will be unable to retain your booking without a paid deposit.

Our copyright
All images taken by us on your behalf remain our property and we possess unlimited copyright. Images may not be copied, by any means whatsoever, or stored electronically, without our express permission in writing.

We may ask your permission to use images taken by us so that we can promote Kennick Photography. Permission to do so will be sought in writing by us.

The term ‘image’ constitutes any digital image file or any other item which may be produced from the image file, including prints, transparencies, or other artwork.

If we provide permission in writing for our images to be used for your own purpose, then we reserve the right to charge an appropriate fee. Our permission is only exercisable once the fee has been paid in full. In granting such permission, we are not granting authority for you to pass on any right of reproduction to a third party.

The terms within this section are extended to the use of any part of an image taken by us, in the preparation of a composite image, digital manipulation of any image.

 

Print quality and colour matching

We will take all reasonable steps to provide you with high quality prints with a pleasing colour balance and will use a professional and recommended printing house to achieve this. We will not pass on prints, which we consider to be of an unacceptable standard

There are many variances within the printing process and we are therefore unable to guarantee that exact colour tone will be achieved, or that reprints will match the colour and tone of the original print.

Therefore we will not consider requests for refunds where the quality of printing is technically acceptable.

Longevity of images
It is understood that all photographs are subject to fading and loss of colour where appropriate, due to a number of natural causes and factors affecting materials and production thereof. We will not be liable for deterioration of images due to poor handling and insufficient care.

It is your responsibility to look after your pictures adequately and we recommend the following precautions are taken to prevent accelerated deterioration:
• Keep this print behind glass.
• Do not subject the print to direct sunlight.
• Prints should not be exposed to moisture and heat.

Our failure to deliver
We will take all reasonable care to ensure we perform to your requirements. However, we will not accept liability for losses arising from operator error, equipment, or material failure. Any losses incurred will be limited to the original purchase price only and neither you, or us will be liable for any consequential loss. In the event of any unforeseen circumstances causing loss of all photographic records every effort will be made to retake the photographs.

We can accept no contingent liability for any failure of any type resulting from the failure in any way of any product or service we supply.

Because of variances in location and human behaviour, for example the agreement of people to be captured on image, we will not guarantee provision of a specific image.

We will not be liable for failure arising from:-
• Act of God, for example Adverse weather conditions
• Loss, theft or other damage to photographic materials, or equipment.
• Disruption, or non arrival of any party associated with the event, for example guests taking photographs and obscuring our field of view.
• Restriction of the photographer to perform assignment.
• The event venue placing any restriction on the taking of photographs
• The photographs not meeting your exact personal taste.
• Failure by you to advise any circumstance, which could affect completion of our duties.
• Your failure to ensure we are furnished with adequate direction to and details of the event venue along with sufficient detail to enable us to contact you.

Prices
Our current price list is available on request or from our website - www.kennick-photography.co.uk

All quotations remain valid for 30 days

Orders for wedding photographs received more than 3 months after the event date, will be subject to current rates, if our prices have changed.

All requested retouching and digital manipulation to images will be charged in accordance with our tariff. However, we will not make additional charge for conversion to monochrome, sepia or other colour toned prints.

Our prices are subject to change at our discretion except where we have agreed a price with you and the order is received within the time period stated above.

Presentation / delivery
Your personal web gallery will be available to view within 14 days from the date of the event.

Prints will be available 28 days from the date we place the order with the printers.

We will advise you how long any digital retouching or manipulation will take.

Other products may take longer to deliver. We will endeavour to inform you of timeframes, but will not be able to guarentee exact dates.

Reorders
All reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing.

Cancellation
You may cancel the contract agreed with us at any time, but you agree that any monies paid as a deposit are non-returnable. However, we will be prepared to use any retained funds towards payment a future booking with us.

General Terms & Conditions:
If, for any reason, we are unable to complete the work agreed with you, we may engage another photographers to complete the work on our behalf.

You must tell us immediately if arrangements for the event we are to photograph have changed.

We will not accept responsibility for print, or image selection errors.

We will not accept responsibility for damage to CDs or DVDs. Appropriate care is your responsibility.

We recommend you take and retain a copy of your booking form.

All prints, or CDs, or DVDs presumed to have been received in good condition unless you advise us within 3 of receipt.

We have taken reasonable care to correctly identify and prepare the images you have requested from us and will not accept liability for any loss or damage incurred by you, or any third party, after the material leaves our possession.

You indemnify us against any claim from a third party arising from unauthorized reproduction of a picture submitted to you by us, as a result of any breach by you of any of these terms and conditions (including but not limited to you allowing a picture, or a copy thereof, to come into the possession of a third party without our prior written consent).

We will not be liable for any physical injury, or loss or damage to property, however or whenever caused.

We reserve the right to amend these terms and conditions without notification
